Terms for the website, app, and paid features.

These Terms of Use govern access to the Preset. website, iPhone app, Messages extension, support services, and any paid plans, subscriptions, or purchases we may offer. Preset. is operated by Jacob Lanning in Queensland, Australia.

Acceptance

By accessing or using Preset., you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website, app, or related services.

Eligibility and platforms

You must be legally capable of entering into a binding agreement to use Preset. If you download or use the app through Apple, Apple's terms, policies, and device rules also apply. If Apple provides the app under its standard licensed application terms, those platform terms apply in addition to these Terms.

What Preset. does

Preset. helps users create, store, organise, and reuse message templates and variable fields for use in Messages and related workflows. You are responsible for reviewing the final message before sending it and for how you use any content created with the app.

Acceptable use

You must not use Preset. to:

  • break the law, infringe rights, or violate any messaging, privacy, spam, consumer, or employment rules that apply to you
  • send unlawful, deceptive, harassing, abusive, discriminatory, or misleading communications
  • impersonate others, misrepresent your relationship with a recipient, or send messages without any consent required by law
  • interfere with the website, app, or underlying systems, including by introducing malware, scraping, or attempting unauthorised access
  • copy, reverse engineer, or exploit the service except to the extent a restriction is not permitted by law

Your content and responsibility

You retain ownership of the text, templates, and other content you create using Preset. You are solely responsible for that content, the recipients you contact, the claims you make, and any legal obligations connected to your communications. Preset. is a productivity tool only and does not provide legal, compliance, regulatory, or professional advice.

Intellectual property

The website, app, branding, software, designs, and related materials are owned by or licensed to Preset. and are protected by applicable intellectual property laws. These Terms grant you a limited, revocable, non-exclusive, non-transferable right to use the service for its intended purpose, subject to these Terms and any platform rules.

Feedback

If you send suggestions, ideas, or other feedback about Preset., you grant us a worldwide, royalty-free, transferable, sublicensable licence to use that feedback for any lawful purpose without restriction or compensation to you.

Paid features, billing, and subscriptions

Paid features are not implemented in the current inspected codebase, but these Terms are intended to govern them when introduced. If we offer subscriptions or paid upgrades in the future, we currently intend to offer them through Apple's App Store using in-app purchase systems. In that case:

  • pricing, billing interval, included features, and renewal terms will be shown before purchase
  • subscriptions may renew automatically until cancelled, if clearly disclosed at purchase
  • purchases will be billed, renewed, and managed under Apple's rules and your Apple account settings
  • refunds, billing support, and subscription cancellation may be handled by Apple where Apple's policies require that
  • we may change pricing prospectively, but not without the notice required by applicable law or Apple's platform rules

Cancellation and refunds

You may cancel a subscription before the next renewal date to avoid future charges. Unless required by law, by Apple, or by an express offer we make, fees are generally non-refundable once a billing period has started. If you bought through Apple, refund requests, subscription management, and cancellation may need to be handled through Apple. Nothing in these Terms limits any rights you may have under the Australian Consumer Law or other non-excludable laws.

If local law gives you a cooling-off, withdrawal, cancellation, or other mandatory refund right for digital content or subscriptions, those rights continue to apply. Where required, we will also obtain any consent needed before immediate access to paid digital content causes a withdrawal right to be reduced or lost.

Availability, updates, and backups

We may update, change, suspend, or discontinue part of Preset. at any time. The current app is designed to store content locally on your device, which means data may be lost if your device is lost, reset, restored incorrectly, or if the app or its local data is removed. You are responsible for keeping any copies or records you consider important.

Third-party services

Preset. may rely on third-party platforms and providers such as Apple, hosting providers, and email providers. We are not responsible for third-party products or services, and your use of them may be subject to separate terms and privacy policies.

Disclaimers

To the maximum extent permitted by law, Preset. is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. We do not promise uninterrupted availability, perfect accuracy, message delivery, compatibility with every device or carrier, or that the service will always be secure or error-free.

Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any guarantee, condition, warranty, right, or remedy that you may have under the Australian Consumer Law or any other law to the extent it cannot lawfully be excluded or limited. Where the law permits us to do so, our liability is limited to the fullest extent permitted by law.

Mandatory local consumer rights

If you live outside Australia, you may also have mandatory rights under the consumer, e-commerce, subscription, unfair contract terms, or digital content laws of your home jurisdiction. Nothing in these Terms removes rights that cannot lawfully be excluded under those laws.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive loss, or for any loss of profits, revenue, business, goodwill, data, or opportunities arising out of or relating to Preset.

To the maximum extent permitted by law, our aggregate liability for claims arising out of or relating to Preset. will not exceed the greater of AUD $100 or the total amount you paid us for the specific paid service giving rise to the claim in the 12 months before the event that gave rise to the claim.

The exclusions and limits in this section do not apply to liability that cannot be excluded by law, including non-excludable consumer rights, and do not limit liability for fraud or wilful misconduct by us.

Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Preset. and its operator from reasonable losses, claims, liabilities, damages, and costs arising from your unlawful use of the service, your breach of these Terms, or your infringement of another person's rights.

Termination

We may suspend or end access to Preset. if we reasonably believe you have materially breached these Terms, created legal risk, threatened security, or misused the service. You may stop using Preset. at any time.

Disputes and governing law

If a dispute arises, please contact us first and we will try to resolve it informally. These Terms are governed by the laws of Queensland, Australia, excluding conflict of law rules. Subject to any rights you may have under applicable consumer law, you and Preset. submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.

The choice of Queensland law and forum does not deprive you of the protection of mandatory laws that apply in the country, state, or region where you live.

Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised date. If changes are material, we may provide additional notice where appropriate. By continuing to use Preset. after updated Terms take effect, you agree to the revised Terms.
